class="Normal" style="line-height:1.0;"><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;font-weight:bold;">第一条 </span><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;">为维护本物业管理区域全体业主的合法权益,规范业主大会、业主委员会的议事活动,根据《物权法》、国家、省、市《物业管理条例》、住房城乡建设部《业主大会和业主委员会指导规则》等有关规定,制定本物业管理区域业主大会议事规则(以下简称“本议事规则”)。</span></p> <p class="Normal" style="line-height:1.0;"><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;font-weight:bold;">第二条 </span><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;">业主大会和业主委员会在其职责范围内依法作出的决定对本物业管理区域内的全体业主和非业主使用人均具有约束力。</span></p> <p class="Normal" style="line-height:1.0;"><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;">任何人不得抵制决定的贯彻执行,不得干扰业主大会和业主委员会的正常工作。</span></p> <p class="Normal" style="line-height:1.0;"><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;font-weight:bold;">第三条 </span><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;">业主大会、业主委员会应当依法履行职责,不得作出与物业管理无关的决定,不得从事与物业管理无关的活动。</span></p> <p class="Heading-2" <p class="Normal" style="line-height:1.0;"><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;font-weight:bold;">第四条 </span><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;">物业管理区域范围及相应的业主大会名称。</span></p> <p class="Normal" style="line-height:1.0;"><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;">(一)物业管理区域范围(四至及附图):</span></p> <p class="Normal" style="line-height:1.0;"><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;">(一)制定和修改业主大会议事规则;</span></p> <p class="Normal" style="line-height:1.0;"><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;">(二)制定和修改管理规约;</span></p> <p class="Normal" style="line-height:1.0;"><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;">(三)选举、改选业主委员会或者更换业主委员会委员;</span></p> <p class="Normal" style="line-height:1.0;"><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;">(四)物业管理形式;</span></p> <p class="Normal" style="line-height:1.0;"><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;">(五)选聘物业服务企业的资质等级、服务内容、标准以及物业服务收费方案;</span></p> <p class="Normal" style="line-height:1.0;"><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;">(六)选聘和解聘物业服务企业;</span></p> <p class="Normal" style="line-height:1.0;"><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;">(九)改变物业管理用房、公共建筑或共用设施的用途;</span></p> <p class="Normal" style="line-height:1.0;"><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;">(十)利用共用部位、共用设施设备进行经营;</span></p> <p class="Normal" style="line-height:1.0;"><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;">(十一)经营性收益的管理、分配与使用;</span></p> <p class="Normal" style="line-height:1.0;"><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;">(十二)在本物业管理区域内设置临时停车位,制定车辆在物业管理区域内行驶、停放、收费等管理制度;</span></p> <p class="Normal" style="line-height:1.0;"><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;">(十三)撤销业主委员会的决定;</span></p> <p class="Normal" style="line-height:1.0;"><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;">(十四)</span><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;text-decoration: underline;">                </span><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;">决定上述第7项和第8项规定的事项,应当经专有部分占建筑物总面积三分之二以上的业主且占总人数三分之二以上的业主同意;决定上述其他事项,应当经专有部分占建筑物总面积二分之一以上的业主且占总人数二分之一以上的业主同意。</span></p> <p class="Normal" style="line-height:1.0;"><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;font-weight:bold;">第六条 </span><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;">业主大会会议应当由业主委员会按照下列程序组织召开:</span></p> <p class="Normal" style="line-height:1.0;"><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;">(一)会议筹备。草拟需业主大会会议表决的内容;确定会议召开形式、时间、地点、议题和议程;制定征询意见表或表决票;核实业主身份、人数、专有部分面积、建筑物总面积等情况;</span></p> <p class="Normal" style="line-height:1.0;"><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;">(二)发布公告。会议筹备内容应当在业主大会会议召开15日前在物业管理区域内书面公告,并将会议时间、地点、议题和议程告知物业所在地街道办事处、乡(镇)人民政府;</span></p> <p class="Normal" style="line-height:1.0;"><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;">(三)发放、回收表决票。按照本议事规则第十六条发放和回收表决票;</span></p> <p class="Normal" style="line-height:1.0;"><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;">(四)统计结果。按照本议事规则第十七条统计表决结果;</span></p> <p class="Normal" style="line-height:1.0;"><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;">(五)会议监督。业主大会会议表决的情况须接受物业所在地街道办事处、乡(镇)人民政府或受其委托的社区居民委员会的监督;</span></p> <p class="Normal" style="line-height:1.0;"><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;">(六)公告会议决定。业主大会会议决定以书面形式在本物业管理区域内进行公告,接受业主的查询和监督;</span></p> <p class="Normal" style="line-height:1.0;"><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;">(七)记录并存档。业主大会会议应当由业主委员会书面记录并存档。</span></p> <p class="Normal" style="line-height:1.0;"><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;font-weight:bold;">第七条 </span><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;">业主大会会议分为定期会议和临时会议。定期会议每年召开</span><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;text-decoration: underline;">    </span><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;">次,召开时间为</span><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;text-decoration: underline;">    </span><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;">月份。</span></p> <p class="Normal" style="line-height:1.0;"><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;">有下列情形之一的,业主委员会应当自情形发生之日起</span><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;text-decoration: underline;">    </span><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;">日内组织召开业主大会临时会议:</span></p> <p class="Normal" style="line-height:1.0;"><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;">(一)经专有部分占建筑物总面积20%以上且占总人数20%以上业主提议,提议事项明确,属于业主大会议事范围且提议业主中有具体联系人;</span></p> <p class="Normal" style="line-height:1.0;"><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;">(二)发生</span><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;text-decoration: underline;">        </span><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;">、</span><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;text-decoration: underline;">        </span><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;">、</span><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;text-decoration: underline;">        </span><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;">天内应当对提议的真实有效性进行核实。经核实,提议真实有效且符合业主大会临时会议召开情形的,业主委员会应当在收到提议之日起</span><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;text-decoration: underline;">    </span><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;">日内按规定召开业主大会临时会议,就提议事项征求业主意见并进行表决,表决议题应与提议议题相一致;提议不符合业主大会临时会议召开情形的,业主委员会应当在</span><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;font-weight:bold;">第九条 </span><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;">业主委员会未按照规定组织召开业主大会会议的,业主可以请求物业所在区、县(市)房产主管部门,街道办事处、乡(镇)人民政府协调、确定召开时间。逾期仍未召开的,根据《杭州市物业管理条例》由物业所在区、县(市)房产主管部门、街道办事处、乡(镇)人民政府指导、帮助社区居民委员会指导业主召开,具体组织工作按照下列第</span><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;text-decoration: underline;">    </span><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;">项操作:</span></p> <p class="Normal" style="line-height:1.0;"><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;">1.委托物业所在地的社区居民委员会实施;</span></p> <p class="Normal" style="line-height:1.0;"><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;">2.由业主成立工作小组实施;</span></p> <p class="Normal" style="line-height:1.0;"><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;">3.</span><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;text-decoration: underline;">                </span><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;">种:</span></p> <p class="Normal" style="line-height:1.0;"><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;">(一)集体讨论的形式;</span></p> <p class="Normal" style="line-height:1.0;"><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;">(二)书面征求意见的形式;</span></p> <p class="Normal" style="line-height:1.0;"><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;">(三)业主委员会于会议召开15日前确定并进行公告。</span></p> <p class="Normal" style="line-height:1.0;"><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;font-weight:bold;">第十一条 </span><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;">业主大会议事方式</span><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-bidi-font-family:SimSun;">业主委员会候补委员递补规则。业主委员会正式委员缺额不超过正式委员总数二分之一的,由候补委员按照得票多少自动递补,业主委员会应当在</span><span
