(一)在其制定的《业主公约》中向业主明示物业装饰装修管理要求等事项;甲方未尽此义务而影响乙方管理服务或给业主、物业使用人造成损失的,乙方不承担相应责任;</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;margin-right:0.0pt;direction: ltr;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;">  (二)督促业主、物业使用人按时交纳物业服务费用;对业主或物业使用人违反《业主公约》的行为予以劝阻、制止;</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;margin-right:0.0pt;direction: ltr;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;">  (三)授权乙方对业主、物业使用人违反《业主公约》的行为,依照《业主公约》的约定进行劝阻、制止;</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;margin-right:0.0pt;direction: ltr;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;">  (四)审查和批准物业管理方案、年度管理计划、年度维修养护计划、年度费用概预算、决算报告,监督、检查乙方各项方案和计划的实施;</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;margin-right:0.0pt;direction: ltr;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;">  (五)</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;margin-right:0.0pt;direction: ltr;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:bold;">  第二十条 </span><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;"> 乙方相关的权利义务:</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;margin-right:0.0pt;direction: ltr;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;">  (一)设立专门机构负责本物业的日常管理工作,并委派具有岗位资格的人员履行本合同;</span></p> <p class="Normal" style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;">  (二)根据法律、法规的有关规定和本合同的约定,开展各项物业管理服务活动,但不得侵害业主、物业使用人及他人的合法权益,不得利用提供物业管理服务的便利获取不当利益;</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;margin-right:0.0pt;direction: ltr;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;">  (三)根据有关法律、法规的规定和本合同的约定,向业主或物业使用人收取物业服务费用,通过合法有效的方式解决拖欠物业服务费的问题;</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;margin-right:0.0pt;direction: ltr;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;">  (四)及时向业主公告本管理区域内的重大物业服务事项,每  个月公布一次专项维修资金和按实结算项目的费用收支帐目;</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;margin-right:0.0pt;direction: ltr;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;">  (五)结合本物业的实际情况,编制物业管理方案、年度管理计划、年度维修养护计划、年度费用概预算和决算报告;</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;margin-right:0.0pt;direction: ltr;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;">  (六)</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;margin-right:0.0pt;direction: ltr;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:bold;">  第二十一条 </span><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;"> 在物业管理服务过程中发生下列事由,乙方不承担责任。</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;margin-right:0.0pt;direction: ltr;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;">  (一)因不可抗力导致物业管理服务中断的;</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;margin-right:0.0pt;direction: ltr;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;">  (二)乙方已履行本合同约定义务,但因物业本身固有瑕疵造成损失的;</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;margin-right:0.0pt;direction: ltr;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;">  (三)因维修养护物业共用部位、共用设施设备需要且事先已告知业主和</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;margin-right:0.0pt;direction: ltr;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;">  物业使用人,暂时停水、停电、停止共用设施设备使用等造成损失的;</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;margin-right:0.0pt;direction: ltr;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;">  (四)因非乙方责任出现供水、供电、供气、供热、通讯、有线电视及其他共用设施设备运行障碍造成损失的;</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;margin-right:0.0pt;direction: ltr;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;">  (五)</span></p> <p class="Normal" style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;"> 甲方违反本合同第六条的约定,致使乙方的管理服务无法达到本合同第二条、第五条约定的服务内容和标准的,乙方不承担违约责任。</span></p> <p 除前条规定的情况外,乙方的管理服务达不到本合同第二条、第五条约定的服务内容和标准的,应以违约事项涉及并收取的服务费为基数向相应业主支付__________的违约金。</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;margin-right:0.0pt;direction: ltr;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;"> 乙方违反本合同的约定,擅自提高收费标准的,对超出标准的部分,业主有权拒绝支付;已经支付的,业主有权要求乙方倍返还。</span></p> <p 甲方违反本合同约定的义务,致使乙方不能完成本合同约定的服务内容和标准的,乙方有权依法解除本合同;造成乙方经济损失的,甲方应予经济赔偿。</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;margin-right:0.0pt;direction: ltr;"><span 乙方违反本合同约定的义务,致使不能完成本合同约定的服务内容和标准的,甲方有权依法解除合同,并有权要求乙方按其减少的服务支出予以赔偿。</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;margin-right:0.0pt;direction: ltr;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;">  甲方解除合同的,乙方应当在甲方通知的合理时间内与甲方或其选聘的物业管理企业完成交接手续。</span></p> <p class="Normal" style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;"> 双方协商一致,可解除本合同,并在日内办理交接手续。</span></p> <p class="Normal" style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;">  (二)物业使用人,是指物业的承租人和实际使用物业的其他人。</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;margin-right:0.0pt;direction: ltr;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;">  (三)物业买受人,是指物业出售合同中确定的物业购买人。</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;margin-right:0.0pt;direction: ltr;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;">  (四)物业交付使用,是指物业买受人收到甲方书面入住通知并已办理相应手续。物业买受人收到入住通知后在限定期限内不办理相应手续的,视为已交付使用。</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;margin-right:0.0pt;direction: ltr;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;">  (五)共用部位,是指一幢住宅内部,由整幢住宅的业主、使用人共同使用的门厅、楼梯间、水泵间、电表间、电梯间、电话分线间、电梯机房、走廊通道、传达室、内天井、房屋承重结构、室外墙面、屋面、   、  、   等部位。</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;margin-right:0.0pt;direction: ltr;"><span (六)共用设施设备,是指:1、一幢住宅内部,由整幢住宅的业主、使用人共同使用的供水管道、排水管道、落水管、照明灯具、垃圾通道、电视天线、水箱、水泵、电梯、邮政信箱、避雷装置、消防器具   、  、   等设备;2、物业管理区域内,由业主和使用人共同使用的道路、绿地、停车场库、照明路灯、排水管道、窨井、化粪池、垃圾箱(房)   、  、   等设施。</span></p> <p (七)公共区域,是指一幢住宅内部,由整幢住宅的业主、使用人共同使用的区域以及整幢住宅外、物业管理区域内,由全体业主、使用人共同使用的区域。</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;margin-right:0.0pt;direction: ltr;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;">  (八)专有部分,是指在构造上及利用上具有独立性,由业主独立使用、处分的物业部位。</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;margin-right:0.0pt;direction: ltr;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:bold;">  第三十条 </span><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;"> 本合同未尽事宜,双方可另行以书面形式签订补充协议。</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;margin-right:0.0pt;direction: ltr;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:bold;">  第三十一条 </span><span
